Virginia man files lawsuit against DePuy

A Virginia man had a DePuy hip recall lawsuit filed on his behalf April 15 against Johnson & Johnson’s DePuy Orthopaedics, Inc. The case will be tried in the U.S. District Court of Texas, Dallas Division.

The victim, who was not named, apparently was severely affected by negative side effects, including severe pain, discomfort, inflammation, and developed difficulty walking after he underwent a total hip replacement surgery on his right and left hips in January and April 2007.

The plaintiff was supposed to undergo another set of surgeries this April, but because of the complications that resulted from his left hip revision surgery in December 2012, the April surgery was rescheduled to September of this year.

The lawsuit claims that, with the plaintiff having to undergo revision surgery, the risk of complications has increased, especially considering his delicate condition.

Surgeon testifies that DePuy hip implants were reported to be safe

A surgeon appearing as a witness for a plaintiff who filed a case against Johnson & Johnson’s subsidiary DePuy Inc. for allegedly manufacturing defective ASR XL metal hip implants testified in an Illinois court room Monday, March 25.

Orthopedic surgeon Tony Nargol, an expert witness for Carol Strum, who is seeking punitive damages after having high concentrations of metal in her blood that were attributed to a DePuy ASR device implanted in January 2008, confirmed that his office created reports indicating the hip implant was safe to use. These reports were used in conferences only months before Strum had her implant put in.

Nargol’s report showed that only three out of the 243 hip implant surgeries performed required subsequent revision operations and that the results were consistent with an in-house DePuy report.

Docs submitted to SEC reveal further federal investigation

Johnson & Johnson’s annual report to the Securities and Exchange Commission, submitted Friday, February 22, revealed that the U.S. Attorney’s Office in Massachusetts and the Civil Division of the U.S. Justice Department sent the company an “informal request” for information about its ASR hip replacements.

The government has also asked for more documents from Johnson & Johnson’s DePuy Synthes, one of the largest manufacturers of joint replacements, surgical trauma equipment, and other orthopedic surgery products. According to documents, the company is complying with the government fully during this investigation.

J&J hip implant design flaw known to company executives as shown through internal documents

Johnson & Johnson executives allegedly knew of a design flaw in its Articular Surface Replacement (ASR) hip implant even before the product’s recall in 2010, as revealed by internal documents during a trial regarding the mechanism’s high failure rate.

Manufactured for the United States market in 2005, the product started getting flak from its users and doctors in 2007 after it failed a test that compared its performance with that of other hip implants and users complained of its tendency to fail prematurely.

The test showed that 40% of ASR implant users will experience having their devices fail within five years, which is eight times the failure rate of other hip implants tested.

Study: Chronic diseases increase risk of sepsis

A study performed by researchers at the University of Alabama at Birmingham uncovered a link between chronic lung, heart, and kidney disease and the increased risk of sepsis. The study also found that risk of future sepsis increases by 85% for people who have experienced a stroke and 71% for people who suffer from diabetes.

Sepsis is a serious condition that affects about 750,000 Americans each year, leading to nearly 200,000 deaths annually. Of those that succumb to sepsis, many are ill or elderly.

During this study, researchers found that sepsis is linked to older age, drinking alcohol, smoking cigarettes, lower education, and lower income. The new study also shows that men are at a higher risk than women and that this condition affects white people more frequently than African-Americans.

A theory as to why chronic diseases are linked to sepsis proposes that the chronic inflammation of cells that line the blood vessels may cause the arteries to become diseased. This makes the immune system weaker when preventing infections, potentially leading to sepsis. However, the exact reason as to why sepsis overlaps with chronic disease is still not known.

Executives for DePuy to testify in hip replacement lawsuits

Eight top executives for DePuy Orthopaedics must testify in the court regarding the recall of DePuy’s ASR hip replacement systems and implants. The executives have been required to testify and will have a few months to gather notes, documents, and other needed materials.

Johnson & Johnson settles first three hip implant lawsuits

Johnson & Johnson is facing thousands of lawsuits over a subsidiary’s defective hip implant product that was recalled in 2010. However, DePuy Orthopaedics, Inc., has settled the first three cases involving the ASR hip implant for about $600,000 total.

The cases were scheduled to go to trial later this year, but the company decided to settle them for about $200,000 each instead of waiting for the results of the trials.

An estimated 93,000 people received DePuy’s ASR hip implants worldwide. Of this number, 37,000 patients are in the U.S.

Statute of limitations deadline nearing for DePuy patients

What is metallosis?

Metallosis is a condition that occurs when flakes of metal embed into a person’s soft tissue.
