Two more lawsuits were recently filed against DePuy Orthopaedics and Johnson & Johnson regarding defective ASR hip implants. Both cases were filed at the St. Clair County Circuit Court in Illinois.
One of the plaintiffs received a DePuy ASR hip implant in September 2008 and the other in August 2007. Both say that their hip implants were defective, causing them to suffer bone fractures and multiple hip dislocations. In addition, the plaintiffs both needed revision surgeries less than 2 years after having the devices implanted.
The lawsuits accuse the defendants of fraud and negligence for promoting a product that they knew was defective. Also, the plaintiffs claim that DePuy and Johnson & Johnson did not adequately warn customers of the chance of hip implant failure with the DePuy ASR and did not properly test the medical device. The plaintiffs requested remedies of more than $250,000.
